1. Definitions
- “ZBWA”
- refers to the Zaveri Bazaar Welfare Association, a not-for-profit registered welfare body.
- “Platform”
- means both the ZBWA mobile application and website collectively.
- “User” or “You”
- refers to any person, including members of ZBWA, accessing or using the Platform.
- “Member”
- refers to an individual or entity formally affiliated with ZBWA.
2. Features of the Platform
The features are as under subject to change from time to time.
3. Binding Nature
By registering on, accessing, or using any portion of the Platform, you unequivocally agree to be legally bound by these Terms. If you do not agree, you must not access or use the Platform. These Terms constitute an electronic record under the Information Technology Act, 2000 and related rules and do not require any physical or digital signature.
4. Registration & Member Accounts
- You must provide true, complete, and up-to-date information while registering.
- You shall not share your login credentials. Any such sharing shall be solely at your own risk.
- ZBWA reserves the right to revoke, restrict, or block access to any User for violations of these Terms without notice or refund.
5. Intellectual Property
All intellectual property—including logos, text, images, videos, data, software, and trademarks—on the Platform is owned or licensed by ZBWA. Unauthorized reproduction, modification, or commercial use is strictly prohibited and may lead to legal action.
6. Acceptable Use
Users shall not:
- Engage in unlawful, threatening, harassing, libelous, defamatory, or obscene conduct;
- Impersonate ZBWA personnel or other Users;
- Attempt to hack, disrupt, or disable the Platform;
- Post or distribute unsolicited promotional materials or spam.
ZBWA may take legal action against any misuse of the Platform.
7. Third-Party Content
ZBWA is not responsible for third-party content or advertisements displayed on the Platform. Users interact with third-party content at their own risk.
8. Disclaimers & Limitation of Liability
ZBWA provides the Platform on an “as is” and “as available” basis. ZBWA disclaims all warranties, express or implied. Under no circumstances shall ZBWA be liable for:
- Loss of data, revenue, or profits;
- Technical errors or service interruptions;
- Damage caused by malware or other harmful components;
- Any damages arising from reliance on content posted by others.
9. Modifications
ZBWA may revise these Terms from time to time without specific notice. Continued use of the Platform after updates shall constitute acceptance of the modified Terms.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with Indian law. The courts of Mumbai, Maharashtra, shall have exclusive jurisdiction over any disputes.
11. Force Majeure
ZBWA shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including but not limited to natural disasters, governmental orders, system failures, or civil unrest.
